Welcome to Book with Navio Travel. By using our services, you agree to these Terms of Service. Please read them carefully.

About Our Services

Book with Navio Travel operates as an independent travel advisor on behalf of Fora Travel, a registered seller of travel with the Travel Industry Council of Ontario (TICO Reg #50027942).

We provide travel booking services and custom travel planning services. Our services include:

  • No-fee booking service for travelers who have planned their own itineraries
  • Custom travel planning service (fee-based: $35 USD or $50 CAD per day of travel)

Booking Services

No-Fee Booking Service

Our booking service is complimentary when you provide your own travel itinerary. We earn commission from our travel partners, which allows us to provide exclusive perks and benefits at no additional cost to you.

Custom Planning Service

Our planning service includes complete itinerary creation, researching and booking all components of your trip. The planning fee is:

  • $35 USD per day of travel (for US-based clients)
  • $50 CAD per day of travel (for Canadian-based clients)

Planning fees are collected after we discuss your vision and before we begin work on your itinerary.

Non-Refundable Planning Fees

Planning fees are non-refundable under any circumstances once payment has been received. This includes but is not limited to:

  • Client-initiated cancellations at any stage of planning
  • Changes in travel plans or dates
  • Force majeure events (natural disasters, pandemics, political unrest, etc.)
  • Inability to travel due to personal circumstances
  • Dissatisfaction with proposed itinerary options

The planning fee compensates for professional time, research, and expertise invested in creating your custom itinerary. This time cannot be recovered regardless of whether you proceed with booking the proposed travel arrangements.

Note: This policy applies only to planning fees. Actual travel costs (flights, hotels, etc.) are subject to the cancellation policies of individual suppliers and may be refundable depending on the specific terms of each booking.

Payments and Pricing

Travel costs are determined by our supplier partners (airlines, hotels, cruise lines, etc.). Prices are subject to change until booking is confirmed and payment is received.

Payment terms and cancellation policies vary by supplier and will be clearly communicated before you confirm any booking.

Payment Methods

We accept the following payment methods:

  • Credit cards (Visa, Mastercard, American Express)
  • Debit cards
  • Bank transfers (for certain bookings)
  • Payment plans (available for select bookings over a certain threshold)

Payment Schedule

For most bookings, a deposit is required at the time of booking confirmation, with the balance due according to supplier requirements (typically 30-90 days before travel). Specific payment schedules will be provided for each booking.

Cancellations, Changes, and Refunds

Cancellation and change policies are set by the travel suppliers (airlines, hotels, cruise lines, etc.), not by Book with Navio Travel. These policies vary by:

  • Type of booking (flights, hotels, packages, etc.)
  • Fare class or rate type
  • Timing of the cancellation or change
  • Supplier-specific terms and conditions

We will assist you with any changes or cancellations, but fees may apply according to supplier policies. Please see our Custom Planning Service section above for our non-refundable planning fee policy.

Refund Timeline

When a refund is approved by a supplier, the timeline for receiving your refund depends on the supplier:

  • Airlines: Typically 7-20 business days
  • Hotels: Typically 5-14 business days
  • Cruise lines: Typically 30-90 days
  • Tour operators: Varies by company (typically 14-45 days)

We will follow up with suppliers on your behalf and keep you informed of the refund status.

Force Majeure

In cases of force majeure events (including but not limited to natural disasters, pandemics, war, terrorism, civil unrest, or government travel restrictions), refund eligibility is determined by supplier policies and applicable travel insurance, not by Book with Navio Travel.

We strongly encourage purchasing travel insurance to protect against unforeseen circumstances.

Travel Insurance

We strongly recommend purchasing travel insurance to protect your investment. Travel insurance can cover trip cancellations, medical emergencies, lost baggage, and other unforeseen circumstances. We can assist you in obtaining appropriate coverage.

Travel Documents and Requirements

You are responsible for ensuring you have all required travel documents, including:

  • Valid passport (with appropriate validity period)
  • Visas and entry permits
  • Vaccination certificates or health documentation
  • Any other documents required by your destinations

While we provide guidance on documentation requirements, it is ultimately your responsibility to ensure compliance with all travel regulations.

Limitation of Liability

Book with Navio Travel and Fora Travel act as intermediaries between you and travel suppliers. We are not responsible for:

  • Acts or omissions of travel suppliers
  • Delays, cancellations, or changes by suppliers
  • Personal injury, illness, or property damage during travel
  • Force majeure events (natural disasters, political unrest, pandemics, etc.)
  • Failure to obtain proper travel documentation
  • Loss or damage to luggage or personal belongings
  • Missed connections or disrupted travel plans
  • Quality of services provided by third-party suppliers

Liability Cap

Our total liability to you for any claims arising from our services is limited to the greater of:

  • The amount of planning fees you paid to us (if applicable), or
  • $500 CAD

This limitation does not apply to claims arising from gross negligence or willful misconduct on our part.

Supplier Responsibility

Travel suppliers (airlines, hotels, cruise lines, tour operators, etc.) are solely responsible for the services they provide. Any claims regarding the quality, safety, or delivery of their services should be directed to the supplier. We will assist you in communicating with suppliers but cannot guarantee specific outcomes.

Communication and Consent

By using our services, you consent to receive communications from us via:

  • Email (to the address you provide)
  • Phone or text message (to the number you provide)
  • Mail (to the address you provide)

These communications may include:

  • Booking confirmations and updates
  • Travel documentation and itineraries
  • Important travel advisories or changes
  • Service-related notifications

You may opt out of promotional communications at any time, but you cannot opt out of essential service-related communications regarding active bookings.

Intellectual Property

All content on this website, including text, graphics, logos, and software, is the property of Book with Navio Travel or its licensors and is protected by copyright and other intellectual property laws.

Dispute Resolution and Governing Law

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Jurisdiction

Any legal action or proceeding arising out of or relating to these Terms or our services shall be brought exclusively in the courts located in Toronto, Ontario, Canada. You consent to the personal jurisdiction of such courts and waive any objection to venue.

Informal Resolution

Before pursuing formal legal action, we strongly encourage you to contact us first at book@naviotravel.com to attempt to resolve the matter informally. We are committed to addressing concerns promptly and fairly.

Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. When we make material changes:

  • We will update the "Last Updated" date at the top of this page
  • We will notify you by email if you have an active booking or inquiry with us
  • For significant changes affecting existing bookings, we will seek your re-acceptance of the terms

Your continued use of our services after changes are posted constitutes acceptance of the modified terms, unless the changes materially affect an existing booking, in which case the original terms will apply to that booking.
